Purpose of the Terms

 

The purpose of this page is to explain the Terms of Use under which You, the user, may use www.jobsatable.com’s on-line service to post, print, and search opportunities and/or user resumes.

These Terms include all statements and policies listed or linked within the website www.jobsatable.com which is incorporated into these Terms by reference. Please read these Terms carefully. If You do not accept the Terms stated here, do not use jobsatable.com and its services. By using jobsatable.com, You agree to be bound by these Terms.

ABLE LLC reserves the right to revise these terms at any time by posting an updated version to this web page. You should visit this page periodically to review the most current terms and conditions. The terms "You" and "User" as used herein refer to all individuals and/or entities accessing jobsatable.com for any reason. The term “post” as used herein shall mean information that You submit, publish, print or display on any part of the ABLE site or elsewhere publicly under the ABLE name affiliation.

ABLE, Inc is committed to respecting the privacy of our users. We strive to provide a safe, secure user experience. These terms set forth the online data collection and usage policies and practices that apply to the ABLE Web Site and do not apply to information we collect in any other fashion such as information from job fairs.

The ABLE Sites contain links to other Web sites over which we have no control. We are not responsible for the privacy policies or practices of other Web sites to which you choose to link from our Sites. We encourage you to review the privacy policies of those other Web sites so you can understand how they collect, use and share your information.  

Eligibility

You must be 18 years of age or the age of adulthood as defined in your place of residency, whichever is older, to use jobsatable.com. By utilizing the jobsatable.com website or accepting these terms, you represent and warrant to ABLE that you, the user, have reached such age and that you have the right, authority and understanding to agree to and abide by these terms. You also represent and warrant to ABLE that you will use jobsatable.com in a manner consistent with any and all applicable laws (state, federal, and international) and regulations.

Registration Information

Jobsatable.com allows users to create individual accounts, which may include personal information, and to make these accounts, or aspects thereof, public. When you register with the ABLE site, you will be asked to create a profile/account and provide ABLE with certain information including, but not limited to, personal information such as a valid email address. Information you submit will be used in accordance with all laws both state and federal and all efforts will be used to keep such information private. 

ABLE does not give out any information to third parties at this time. Should this policy change, ABLE agrees to inform you of such policy changes either through the use of a public access page or by email. 

You understand and acknowledge that you have no ownership rights to your account and that if you cancel your account, all your account information from ABLE, including but not limited to resumes, profiles, cover letters, network contacts, and email mailing lists, will be marked as deleted in ABLE's database and will be removed from any public area of the ABLE site. Information may continue to be available for some period of time because of delays in propagating such deletion through ABLE’s web servers. Although ABLE will remove information from any public area, the information will be stored in ABLE files for private company use and will be treated during that time period as private information following all state and federal laws regarding such private information.

You are responsible for maintaining the confidentiality of your account/profile and passwords, as applicable, and if you/your company are ABLE subscribers, your billing account information. You may not share your password or other account access information with any other party. You shall be responsible for all uses of your jobsatable.com registrations and passwords, whether or not authorized by you. You agree to immediately notify ABLE of any unauthorized use of such information so that appropriate security measures may be taken

ABLE authorizes You to view and access a single copy of the content available on or from jobsatable.com solely for your personal use or for use by you as a representative of a company who’s name you are registered under. Content such as but not limited to text, graphics, images, etc and other ABLE content of jobsatable.com and of all other web sites owned/operated by ABLE, are protected under both United States and foreign copyright and trademark laws. All ABLE content, unless otherwise specified, is the property of ABLE LLC. Unauthorized and unlawful use of the ABLE content is strictly prohibited.  

You agree not to sell or modify the ABLE content or reproduce, display, distribute, or otherwise use the ABLE content in any way public or private, in connection with products or services that are not those of jobsatable.com. and under any other circumstance without the expressed written permission of ABLE. ABLE retains all intellectual property rights to this site. You further agree not to misuse the ABLE content that appears on this website.

ABLE Site Restrictions 

Users may not use any ABLE Site in order to transmit, post, distribute, store or destroy material, including but not limited to ABLE Content in a manner that will infringe the copyright, trade secret, intellectual property rights, etc. of the company or violate the privacy, publicity or other personal rights of others. Users may not use any ABLE Site in order to transmit, post, distribute, store content which is defamatory, obscene, threatening, abusive or hateful. 

Users are also prohibited from violating or attempting to violate the security of any ABLE Site including but not limited to such activities as accessing data not intended for such User or logging into a server or account which the User is not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, attempting to submit a virus to any ABLE Site, overloading, flooding, spamming, etc., forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Such violations may result in civil and/or criminal liability. ABLE will investigate occurrences which may involve such violations and will inform and cooperate with law enforcement authorities in prosecuting any person(s) who are involved in such activities.  

ABLE reserves the right to limit the amount of data (including resume views) that may be accessed by you in any given time period and may be amended at ABLE’s sole discretion from time to time.

Specific Prohibited Uses

The job posting, resume database and other features of jobsatable.com may be used only for lawful purposes by individuals seeking and career information and employers seeking employees. ABLE’ networking and profiles may be used only for lawful purposes by individuals for the personal or professional purposes of .

WE AT ABLE STRIVE TO INSURE BUT DO NOT GUARANTEE ANY ABLE SITE AND ITS’ SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. Limitation of Liability

ABLE'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY ABLE SITE OR YOUR USE OF THE ABLE CONTENT, REGARDLESS OF THE CAUSE OF ACTION WHETHER IN CONTRACT, BREACH OF WARRANTY OR ANY OTHER REASON NOT SPECIFIED, WILL NOT EXCEED A TOTAL OF $50 OR A VALUE EQUAL TO $50. BY AGREEING TO THESE TERMS AND REGISTERING WITH ABLE, YOU AGREE TO THE LIMITS OF LIABILITY.

Indemnity

ABLE shall provide notice to you promptly of any such claim, suit, or proceeding.

Term and Termination

These Terms will remain in full force and effect while you are a registered User of jobsatable.com at any level. ABLE reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of your User Content from jobsatable.com and immediately terminate your registration with or ability to access jobsatable.com or any other services provided to You by ABLE. Upon any breach by You of these Terms or if ABLE is unable to verify or authenticate any information You submit to jobsatable.com or pursuant to other ABLE Site registration your user priviledges may be revoked. Even after You are no longer a user of jobsatable.com, certain provisions of these Terms will remain in effect.

Outside the United States

Your data will be stored and processed in whole or in part in the United States. The information we gather on the ABLE Sites may be shared within the ABLE-affiliated companies (those companies which have registered through us) on a worldwide basis in order to deliver the products and services we offer to employers such as searches for job seekers.  

ABLE has intended for the use of it’s site to be used inside the United States or by those who are governed by US law. ABLE makes no claims that the ABLE Content may be lawfully viewed or accessed outside of the United States. Access to the ABLE Content may not be legal by certain persons or in certain countries. If you access jobsatable.com from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within the state of Texas. If any provisions of these Terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. In addition, ABLE’s failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect ABLE’s ability to enforce such term at any point in the future. These terms constitute the entire agreement between You and ABLE with respect to the use of jobsatable.com. No changes to these terms shall be made except by a revised posting of this page. Terms regarding 3rd party software or the such shall have their own terms and should be referenced separately.  

ABLE shall make every attempt to follow all laws state and federal regarding it’s site, content, and use of the site. ABLE will never willfully break any laws. Anyone believing some use or content not to follow such laws may report the information to ABLE so that any investigation into the laws may be made and corrections with regard to these findings may be implemented.
